Working with Direct Medical Resolutions is simple and discreet. Whether you are responding to a patient who has requested that your practice participate in settlement negotiations, or you want DMR to proactively engage a high-risk or potentially litigious patient, you provide basic case details through our secure, HIPAA-compliant, intake process. We prepare a clear summary, handle patient outreach, and manage the back-and-forth directly until the parties reach agreed terms, or it becomes clear that resolution is not possible. If resolution is reached, settlement documents are executed by both sides, and payment is made promptly under the agreed terms, directly to the patient. Negotiations can begin within days, and matters often resolve within weeks.

How It Works

Step 1: Execute the Business Associate Agreement (BAA)

Before any patient-identifying information is shared, your practice completes the Business Associate Agreement below. Once it’s signed, we will send a Physician Intake Form and provide instructions for returning it through our designated, secure, HIPAA-aligned intake email or fax.

Step 2: Submit Physician Intake

We send your practice a Physician Intake Form. Provide the basic facts of the matter, including the patient name, date(s) of treatment, location of care, physician(s) involved, and a concise summary of the concern. Medical records are not required at this stage. The PIF is returned to Direct Medical Resolutions through secure channels.

Step 3: Rapid Review and Fit Assessment

Direct Medical Resolutions confirms whether the case is appropriate for early resolution and identifies any additional information needed to proceed.

Step 4: Patient Outreach

Direct Medical Resolutions serves as a discreet intermediary. If a patient contacts us first, we confirm whether the physician is open to early resolution discussions outside the litigation pathway. If a physician engages us first, we contact the patient to confirm that early resolution and prompt compensation may be available before the matter escalates into years of formal litigation.

Step 5: Resolution Discussions

A confidential resolution discussion is scheduled. Direct Medical Resolutions manages the back-and-forth efficiently and professionally. Discussions continue until the parties reach agreed terms, or it becomes clear that resolution is not possible.

Step 6: Settlement Documents

If resolution is reached, settlement documents are prepared and sent to both parties for signature. These documents typically include a mutual release to prevent either party from bringing future claims related to the same incident, along with confidentiality and non-disparagement terms.

Step 7: Payment and Closure

Once both parties sign the agreement, payment is made promptly, often within days, directly to the patient under the agreed terms. Then the case is closed.
